Statement on behalf of the European Union by Mr. Peter Woeste, Minister Counsellor, Permanent Mission of Germany on Agenda Item 177 "Programme budget for the biennium 2006-2007: Conditions of service and compensation for officials other than Secretariat officials: Judges". United Nations General Assembly, 61st Session, Fifth Committee.
Mr. Chairman,
I have the honour to speak on behalf of the European Union. The Candidate Country the Former Yugoslav Republic of Macedonia, the Countries of the Stabilisation and Association Process and potential candidates Serbia and Albania as well as Ukraine align themselves with this declaration.
The European Union would like to thank Ms. Marianne Brzak-Metzler, Chief of Conditions of Service Section, for the presentation of the report of the Secretary General, as well as to Mr. Rajat Saha, Chairman of the ACABQ, for his presentation of their report.
The courts and tribunals of the United Nations are enhancing the prestige of our organization in the public opinion. Rulings of the UN-judges have contributed substantially to further develop the public international law and to ensure that the rule of law will reach all corners of the world. The EU would like to pay tribute to the judges, public prosecutors and all court personnel and assure all legal personnel of our unreserved support in their responsible and precious work.

The European Union notes that the comprehensive report contains information and proposals on all the elements requested by the Secretary General in the section III, paragraph 8 of resolution 59/282.
The European Union notes in particular the argumentation regarding the proposal of the Secretary General to apply the post adjustment system for remuneration for judges of the International Court of Justice, the ICTY and the ICTR, which is the same system as is applied for the Secretariat staff.
I would like to underline that the work of judges of different courts and tribunals is equally valuable and important to us. The EU is prepared to look into the proposals while recognising that judges exercise a special function and are elected members of a principle organ in accordance with the Charter of the United Nations. Their salaries and conditions of service have to be decided by the General Assembly also bearing in mind the ACABQ report.
We are looking forward to discussing all above mentioned issues in more detail in the course of the informal consultations with a view to finding the best-possible solutions.
